Moving to another country is rarely just a personal matter. It is also about work, rent or homeownership, the children's school, and the safety of the whole family. At family reunification of a foreigner<\/a> In Bulgaria, a single missed certification or inappropriate document can delay the process by months. Therefore, before submitting the first application, it is necessary to carefully study the correct procedure and prepare all documents. This will avoid the risk of the migration service at the Ministry of Interior issuing a refusal or giving you a deadline to submit additional documents.<\/p>\n

The procedure is not the same for every foreigner. The citizenship of the individuals, the type of residence of the family member already in Bulgaria, the family relationship, and the place from which the application will be submitted all matter. Who can request family reunification for a foreigner<\/h2>\n

Most commonly, this procedure is applied when a foreigner from a non-European Union country is already legally residing in Bulgaria and wishes for his or her spouse and minor children to live with him or her. The right to family reunification is usually tied to the authorized residence of the person who is in Bulgaria. Their status must be among those that allow family members to be invited, rather than merely proving short-term residence.<\/p>\n

The law considers the husband or wife and children under 18 years of age, including adopted ones, as core family members. In certain hypotheses, other relatives also fall into this circle, but this is not always the case. The specific family relationship and the possibility of independent maintenance must be assessed.<\/p>\n

Several different procedures must not be mixed. If the family member is a citizen of the European Union or is joining an EU citizen, the rules will be different. Other specifics are taken into account when the foreigner is a family member of a Bulgarian citizen, has humanitarian status, or resides on the basis of a work permit,\u201eEU Blue Card<\/a>\u201c, investment, or another special category. The exact legal qualification at the beginning will ensure that the wrong procedure is not chosen, which would lead to a refusal.<\/p>\n

How does the family reunification of a foreigner take place?<\/h2>\n

In the most common case, when the family member residing in Bulgaria is from a non-EU country, the procedure goes through three consecutive stages. First, the family member who is already in Bulgaria submits a set of documents to the Migration Department of the Ministry of Interior.<\/p>\n

At the next step, the family member who is still abroad applies for a long-term residence visa \u2013 a Type D visa \u2013 at the Bulgarian diplomatic or consular representation in their place of residence. In the final stage, after entering Bulgaria, he or she submits an application for a prolonged residence permit to the competent Migration Directorate.<\/p>\n

This distinction has practical significance. The approval of a D visa does not mean that the procedure has been successfully completed. Following it, a separate stage of the procedure is provided, in which documents are submitted again and it is verified whether the conditions for residence are met. The documents must be valid both when applying for the visa and upon their subsequent submission after the family member arrives in Bulgaria.<\/p>\n

Sometimes people plan to bring their close relative as a tourist first and then \u201esort out the documents.\u201c This is an extremely risky decision. The grounds for entry, the duration of legal stay, and the eligibility to apply from the territory of Bulgaria must be checked in advance. Do not rely on verbal assurances or the claimed experience of an acquaintance\u2014a small difference in status can completely change the applicable rules.<\/p>\n

The documents that most frequently decide the outcome<\/h2>\n

The administration does not only assess whether two people claim to be a family. It checks whether the family relationship is duly certified with a document, whether the person in Bulgaria can provide real living conditions, and whether there are indications that the aim is to circumvent immigration rules \u2013 for example, through a marriage concluded solely for the purpose of the foreigner arriving in Bulgaria, and thereby in the European Union.<\/p>\n

Valid passports, a marriage certificate and children's birth certificates, documents for the person's legal residence in Bulgaria, proof of accommodation, means of subsistence, and health insurance documents are usually prepared. Depending on the case, a criminal record certificate, declarations, documents for exercising parental rights, consent from the other parent, or proof of income may also be required.<\/p>\n

Foreign civil status acts often cause the greatest delay. They may need an apostille or another form of legalization, as well as a translation into Bulgarian in accordance with the applicable procedure. Not every notarization abroad is sufficient and not every translation will be accepted. The requirements depend on the country of issuance and the international rules that apply to it.<\/p>\n

The availability of housing must also be convincingly proven. A rental agreement, title deed, or other document for use may be necessary, but its specific content also matters. If the address, rental period, parties to the contract, or the actual possibility for the family to live there are unclear, this creates a risk of refusal. In the case of a rented property, for example, it should be verified whether the contract actually allows the accommodation of all family members.<\/p>\n

Subsistence funds are not limited merely to having money in an account on the day of submission. It is also verified whether they are sufficient in relation to the number of household members. An employment contract, other remuneration, income from one's own business, bank statements, and tax documents can be part of the complete set of documents. The minimum requirements and the practice of the specific migration office should be checked as of the date of application.<\/p>\n

How is it proven that a family relationship is real<\/h2>\n

In the case of a marriage contracted immediately before the application, prolonged actual separation, or contradictory data in the documents, a more in-depth check by the administrative services is possible. In itself, the short duration of the marriage is not proof that it is fictitious, but it can nevertheless be taken into account.<\/p>\n

In this case, evidence of cohabitation and a lasting relationship may be useful \u2013 shared addresses, correspondence, photographs from various periods, travel data, financial transfers, or documents regarding children born to the couple. These materials should not be submitted \u201eall at once\u201c without prior review. They must clarify specific issues without replacing official documents of marriage or kinship.<\/p>\n

In the case of children, special attention is paid to parental rights. If one parent remains outside of Bulgaria, their explicit consent for the child's travel and settlement, or a court order regulating the matter, may be required. Here, any hasty action can lead to a refusal and the need to start the procedure all over again.<\/p>\n

Deadlines, rejections, and preparation<\/h2>\n

It is not possible to predict the exact completion date of the procedure. The timeframe depends on the specific consulate, the workload of the administration, the need for additional checks, and the quality of the submitted documents. The greatest delays usually arise not from the review itself, but from incomplete documents, expired legalization, name discrepancies, or the need to issue a new certificate abroad.<\/p>\n

A refusal does not always mean that the family does not have the right to live together in Bulgaria. Sometimes the problem is rectifiable \u2013 for example, inadequate housing proof or unclear translation. In other cases, the possibility of a court challenge must be assessed according to the type of act issued by the authority, the stated motives, and the applicable deadlines. The reaction should be prompt, but not without careful research and the formulation of a court strategy: for this purpose, the exact reason for the refusal is analyzed first.<\/p>\n
