Frequently Asked Questions
Within what period can I appeal against an administrative act?
Usual: 14 days from service. In some cases, 7 days or 1 month. In the case of an implied refusal, the time limit starts to run from the moment when the time limit for the administration's decision expires.
Can a company appeal an act of a municipality or state agency?
Yeah. Every company has the right to appeal against administrative acts that adversely affect it. This is done before a superior authority or directly before an administrative court.
What is an "implied waiver"?
If the administration does not respond to your request in time, this is considered a refusal, which you can appeal. It is important to keep an eye on the deadlines and respond in time.
If I appeal, will I stop the action?
Basically, no. But a stay of provisional execution can be requested if the act poses a risk to your business. This is done by a separate request to the court.
Do I need a lawyer to appeal an act of the administration?
Not required, but highly recommended. The procedures are strictly formal and you will need to make a legal argument and be familiar with the practice of the authorities in similar cases.
